HMLR’s Temporary Measures for Deed Signing and Identity Verification

In response to the evolving public health situation, the HM Land Registry (HMLR) has introduced temporary modifications to the processes of deed signing and identity verification as of May 4, 2020. These adjustments aim to enhance accessibility while ensuring security against fraud and are subject to periodic reviews.

The Mercury Signing Approach

One significant change is the adoption of the ‘Mercury signing approach’, permitting deeds to be signed through a combination of physical and digital methods. As outlined, individuals must:

  • Capture their signature on a designated page using a camera or scanner.
  • Send the signed image to their conveyancer via email.

It is crucial to note that signatures must still be physically inked and witnessed in person. For more comprehensive guidelines, practitioners are encouraged to consult HMLR’s updated Practice Guide 8 and the new Practice Guide 67A.

Updated Procedures for Evidence of Identity

Given the limitations placed on public access to HMLR offices, the identity verification process has also been revised to facilitate compliance with health guidelines. Key changes include:

  • Applications will not be rejected due to missing identity evidence.
  • Forms ID1 or ID2 dated within the last six months will be accepted.
  • Additional professionals outside of the conveyancing field can now verify identities via secure video calls (e.g., Skype, FaceTime).

It is important for applicants to understand that HMLR will introduce three new identity forms, with ID5 being particularly relevant for conveyancers. Additionally, updates to Practice Guide 67 will reflect these changes.

List of Approved Non-Conveyancers for Identity Verification

To broaden the scope of identity verification, HMLR has identified specific professionals authorized to validate identities apart from conveyancers. This list includes:

  • Retired conveyancers, solicitors, and barristers
  • Bank officials and regulated financial advisors
  • Medical doctors and dentists
  • Chartered and certified accountants
  • Police officers and magistrates
  • Veterinary surgeons and members of Parliament
  • Welsh Assembly members, teachers, and higher education faculty
  • UK civil servants at the SEO grade or above
  • Members of the UK armed forces

For verification to hold validity when conducted by professionals other than conveyancers, specific conditions must be met.
